Philips CPAP And Sleep Apnea Machines

Philips recalled millions of CPAP and other sleep apnea machines after a machine defect caused many users to breathe toxic foam. The ingestion of this foam cause major health problems, such as cancer.  In addition, many users reported headaches, upper airway irritations, coughing, chest pressure, sinus infections, asthma, damage to their liver and kidneys, nausea, vomiting, and increased breathing problems.

Ongoing Class Action Litigation

In June 2021, a class-action lawsuit was filed against Philips in Massachusetts. It was alleged that Philips knew about the toxic foam and its effects.  People claim that the issue existed for many years. However, Philips neglected to issue a public warning until April of 2021.  It took Philips another two months before recalling the devices, which coincidentally occurred around the time that their newest device was released.  Many patients desperately rely on these devices and had no choice but to purchase the newer machine. Consequently, Philips continued to profit throughout the entire process.

Design Defects

People filed lawsuits against Philips because the devices that Philips sold to the public were defective and dangerous. The foam used was so toxic that it caused cancer.

Failure to Advise or Warn of Dangers

In addition to selling defective and dangerous products, but they also failed to promptly warn the public of the risks. Philips was aware of the defects for years, as a number of allegations exist of users complaining of health issues as a result of the foam. At the very least, Philips became aware of the issue in April 2021 and neglected to issue a recall until the middle of June 2021. Philips, having knowledge of the risks involved, allowed people to continue to buy and use the machines for at least two months.
